TERMS AND CONDITIONS
The company means Trade Lines Shop Equipment Ltd.
The customer shall mean any persons, firm, company or organisations to which the company agrees to sell the goods.
The goods shall mean the goods (and any parts thereof) the subject of the matter of the contract as described in these conditions and if appropriate on the face of the company's acknowledgement of order form.
The works shall mean all works of supply and fit of the goods (and any part thereof) the subject matter of the contract as described in these conditions and if appropriate on the face of the company's acknowledgement of the order form.
ORDERS
The company reserves the right (without prejudice to any other remedy) to cancel any uncompleted order or to suspend delivery in the event of the customer commitments with the company not being met.
OWNERSHIP - Retention of title
All products are the property of the company until payments are made in full. The Company reserves the right to collect any items that are in dispute from the customer, and the customer shall remain liable only until payment is made.
PRICES
Whilst every endeavour has been made to ensure the accuracy of the prices quoted, no responsibility can be accepted for any error or omissions. Prices are subject to alteration without notice and are exclusive of V.A.T., Carriage and Insurance.
Any account outstanding beyond our credit terms of reference will be passed to our Debt Collection Agency and will be subject to a surcharge to cover the cost incurred: such accounts will also be subject to any other costs incurred in obtaining settlement.
PAYMENT
All accounts outstanding beyond 30 days are strictly net and all payments due under this contract will be paid in full without set-off,
deduction or counterclaim. Accounts where terms have been agreed are payable on demand but in any case must be paid by date which will ensure payment is received by the company nor later than 30 days following the date which the goods are dispatched. In the event that any invoice becomes overdue, all invoices become payable immediately.
DISPATCH DATES
Any times quoted for dispatch are treated as estimates only. Whilst every endeavour will be made to meet these estimated times for dispatch the company shall not be liable in any manner whatsoever for failure to dispatch within the times quoted.
DELIVERY
Unless otherwise specified, next day delivery is always attempted, but not guaranteed.
Any damages or shortages must be notified to Tradelines within 3 days of delivery
RETURNS
Previously agreed returns for credit must arrive in as new condition as supplied.
COMPLAINTS
Any complaints by the customer relating to any invoices must be notified by the customer to Tradelines in writing within 3 days of the date of the invoice.
WARRANTIES AND LIABILITY
a. The company warrants that upon delivery, the goods shall be reasonably fit for the purpose for which the customer has made known in writing to the company, and shall be of merchantable quality and shall correspond with the description with which they are sold.
b. For the guarantee period stipulated by the company in respect of each relevant product the company shall make goods free of charge any defect in goods.
c. All products carry to base guarantee only unless otherwise stated.
d. The company shall not be liable for any breach of the above warranties or guarantees (‘’The warranties’’ and ‘’The guarantee’’)
- Unless the customer has paid to the company all monies payable on or by the date stipulated for payment.
- If the goods have been modified, altered or otherwise tampered with in any way other than by duly authorised representatives of the company.
- If the goods have subjected t misuse, neglect, carelessness, lack of maintenance, vandalism or other commotion disturbance or whatever nature whether affecting the goods directly or indirectly as a result of any such matter affecting the premises in which the goods are situated.
LEGAL CONSTRUCTION
These conditions and the contract to which this document relates shall in all respect be constructed in accordance with English Law.
